Thank you for visiting ThePatentBox.com (the “Website”) and for using our online and offline services, including, without limitation, our online platform service and any data, reports and other materials we may provide to you in any physical or electronic form (collectively, the “Services”). The Services are owned by and brought to you by The Patent Box, LLC, a Pennsylvania limited liability company (“The Patent Box” or “we” or “us” or “our”). We are committed to protecting your privacy, and for that reason, we have adopted this Privacy Policy to inform you about our data collection, use and disclosure practices. This Privacy Policy applies to anyone using or browsing our Services or who communicates with us through email or by telephone, and to information provided to us via the Services by visitors, customers or other users of the Services (“users,” “you” or “your”). However, it does not apply to our vendors, employees and contractors. We encourage you to read this Privacy Policy carefully before using the Services. By using the Services, you consent to the practices described in this Privacy Policy, and the collection, use and transfer of your information as described herein. Additionally, whenever you register or act on behalf of a business while using the Services, you represent and warrant that you have the authority to bind that business entity to this Agreement.

1. Consent

By using or registering to use the Services, you consent to this Privacy Policy and you represent and warrant that you are at least 18 years old. If you do not agree with any provisions of this Privacy Policy, you may not use the Services. Information collected through the Services may be transferred, used, and stored in the United States and in foreign jurisdictions in which we, our users, or our agents and service providers for the Services are located, either now or at any time in the future. If you access the Services, you consent to the collection, storage, transfer, use, and processing of your Personal Information (as defined below) in and between all of those jurisdictions. The data protection and other laws in some countries and jurisdictions (such as the Federal laws and the laws of some states within the United States) are not as comprehensive or stringent as the privacy laws in other countries and jurisdictions (such as the laws of the European Union). You agree that all transactions relating to the Services shall be deemed to have occurred in the United States, where we currently have all of our personnel and operations.

2. Collection of Information

We may collect Personal Information in connection with our Services.  When we use the term “Personal Information” we are referring to information that can be used to identify an individual and may include, but is not limited to, first and last name, email address, corporate address, business name, business telephone number, and any other personally identifying information you choose to transmit to us through the Services (including any such information that you include in a “Job Opportunity” that you post on the Services).

“Personal Information” also includes any credit card or debit card or other financial account information you may provide to us or to our third-party payment application provider for billing purposes. However, we send billing and payment information, including any credit card, debit card, or bank account information, through third-party payment and billing systems and do not store any such information on our servers.

The Patent Box may also collect non-Personal Information (aggregate, anonymous, or otherwise non-individually identifiable information) through the use of cookies, web beacons and other similar technologies, as described in Section 5 below.   

Examples of non-Personal Information we collect are:

  • Your Internet Protocol (IP address);
  • Information about your computer or mobile device, such as its maker or operating system version, and HTTP header information;
  • The pages of our website that you viewed during a visit; and
  • Unique identifiers that are not connected and cannot reasonably be connected to your identity.

2. Use of Personal Information

The Patent Box may use Personal Information to assist us in setting up accounts and processing transactions you request (for example, billing information is used to process payments for Services you have signed up to receive); to improve and manage online operations; to provide you with newsletters, RSS feeds, surveys, reports, and/or other communications or services for which you have signed up or which you have otherwise agreed to receive; for customer service purposes; for notifying you about The Patent Box and partner products and services which we think would be of interest to you (including notifying you about Job Opportunities which are advertised by us or our partners via the Services); and to perform research and analysis aimed at improving our products, services and technologies. We will only use your Personal Information in the way we specified when it was collected (including as described in this Privacy Policy). We may use non-Personal information in any of the ways we use Personal Information, as well as for internal purposes to help us diagnose problems, to monitor traffic patterns, to keep you logged in, to measure your use of the Services so we know how much to charge you, to continually improve our Services, and for any other reason if we deem such use, in our sole discretion, to have a legitimate business or legal purpose. 

3. Disclosure of Personal Information

Except as otherwise stated in this Privacy Policy, or unless you specifically ask or authorize us to do so, we do not sell, trade, rent or otherwise share with third parties or other users any Personal Information that we collect from you. However, we may disclose Personal Information and non-Personal Information to companies, agents, contractors, service providers or others engaged to perform functions on our behalf (such as providing data storage, hosting the Services, marketing our products, conducting audits, processing payments, detecting and diagnosing errors, collecting feedback, and performing web analytics). In addition, when you include Personal Information in a Job Opportunity posting on the Services, you acknowledge and agree that we may share that Personal Information with our third-party marketing partners who may include and display such Personal Information on their own job opportunity boards and listings webpages.

We may also disclose your Personal Information to third parties when we believe, in good faith and in our sole discretion, that such disclosure is reasonably necessary to (a) enforce or apply the terms and conditions of the Services, including investigation of potential violations thereof, (b) comply with legal or regulatory requirements or an enforceable governmental request, (c) protect the rights, property or safety of The Patent Box, our users or other third parties, (d) prevent a crime or protect national security, or (e) detect, prevent or otherwise address fraud, security or technical issues.

Lastly, we may also disclose non-Personal Information, aggregated with information about our other users, to our clients, business partners, merchants, advertisers, investors, potential buyers, and other third parties if we deem such disclosure, in our sole discretion, to have sound business reasons or justifications. We may partner with advertisers to provide you with special offers, or to advertise products or services to you. If you redeem or respond to an offer, we may provide your Personal Information to the advertising partner. If you answer questions or fill out surveys from an advertiser, we may share information with that advertiser. The advertising partner’s privacy policy will govern their use of your information, which may include marketing of other products or services to you.

The Patent Box reserves the right to transfer your information (including your Personal Information) to a third party in the event of a reorganization, spin-out, sale, merger, or transfer of all or substantially all of the assets of our company to such third party, or in the unlikely event of a bankruptcy, liquidation or receivership of our business, and you hereby consent to any such transfer of your information. If any such transfer is required, we will make reasonable efforts to notify you in writing in advance by posting a notice on our website and/or emailing you at your contact email address of record and to ensure that the transferee will continue to use any Personal Information collected from you prior to the transfer in accordance with the terms of this Privacy Policy.

Please also note that the Services may link or integrate with third-party sites, services or apps. We are not responsible for the privacy or security policies or practices or the content of such third parties. Accordingly, we encourage you to review the privacy and security policies and terms of service of those third parties so that you understand how those websites collect, use, share and protect your information.

4. Accessing and Updating Personal Information

We make good faith efforts to provide you with access to your Personal Information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests. We will not charge you for any Personal Information access and correction services, except where doing so would require a disproportionate effort.

You can opt out of receiving marketing e-mails from us by clicking on the “unsubscribe” link in the e-mails. Please note that it may take up to ten (10) business days for your opt-out request to be processed. Also, even if you opt out of marketing e-mails, we may continue to send you certain account-related e-mails, such as notices about your account and confirmations of transactions you have requested.

Please e-mail us at inquiries@thepatentbox.com with any questions if you need assistance accessing, changing or deleting your Personal Information. If you request that we delete your Personal Information, please understand that we may need to retain it for a limited period of time to satisfy our legal, audit and/or dispute resolution requirements.

5. Cookies and Automatic Information Gathering Technologies

Non-Personal Information (including aggregate, technical or demographic information) can also be collected through the standard operation of our internet servers and logs as well as other automatic data collection tools such as “cookies,” “beacons” and other similar technologies. We do not use cookies, beacons or similar technologies to collect Personal Information. However, we may engage service providers who may use cookies, beacons or similar technologies to determine when you open email communications sent to you by The Patent Box, and to collect results to surveys we may send you to complete via our third party service providers.

Information we may collect through cookies and similar technologies includes your browser type, IP address, language preference, operating system, the date and time of each user visit or request, and the pages visited on the Services. Any information collected on the Services through the use of cookies, beacons or similar technologies is not associated with your Personal Information and will not be shared with third parties for their direct behavioral tracking or ad targeting purposes, and we do not currently permit advertising networks or other third parties to collect information on our Website for these purposes. However, we allow our standard website analytics providers (e.g., Google Analytics) to collect non-Personal Information through the use of cookies. We use information collected by us and by our third party analytics providers through cookies and similar technologies to improve the user experience, maintain and operate the Services, learn more about our user base, and for other business purposes.

Cookies may be prevented by activating the function that is available in most web browsers that enables the user to deny or accept cookies. Recognize, however, that cookies may be necessary in order to provide certain features of the Services, such as the customized delivery of information.

At this time, the Services do not respond to “do not track” signals that may be sent from your browser.

7. Minors

We do not knowingly collect Personal Information from users under the age of 18. Nor do we authorize users under 18 years of age to use the Services.  If we learn from an individual under the age of 18 or from the individual’s parent or legal guardian that we have collected Personal Information about such an individual, we will make commercially reasonable efforts to delete their Personal Information from our systems.  

8. Information Security

We utilize reasonable information security measures to safeguard your Personal Information. For example, we store your passwords in encrypted form, and we use SSL encryption in connection with pages where we collect payment-related information in connection with our third party payment gateway service providers. Unfortunately, however, no data transmission over the Internet and no method of data storage can be guaranteed to be 100% secure.  Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its security.

9. Your California Privacy Rights

A California resident who has provided personal information to a business with whom he/she has established a business relationship for personal, family, or household purposes (“California Customer”) is entitled to request information about whether the business has disclosed Personal Information to any third parties for the third parties’ direct marketing purposes. We will not share Personal Information with third parties for their own direct marketing purposes unless you affirmatively agree to such disclosure. To prevent disclosure of your Personal Information for use in direct marketing by a third party for its own purposes, do not opt in to or authorize any such use when you provide Personal Information on our Services or when signing up for our e-mail list. 

California Customers may request further information about our compliance with California’s privacy law by e-mailing inquiries@thepatentbox.com. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through this e-mail address.

10. Changes to this Policy

The Patent Box may modify or update this Privacy Policy periodically with or without prior notice to you. We encourage you to check this Privacy Policy from time to time and to refer to the “Last Updated” date at the bottom of this document to see when the Privacy Policy was last changed. We may post a notice of any changes to this Privacy Policy on the Services or e-mail you about the changes. Your continued use of our Services following the effective date of an updated Privacy Policy constitutes your consent to the contents of the updated policy. However, we will not apply any material changes retroactively to any information we collected from you before such changes took effect, without your affirmative consent to do so. IF YOU DO NOT AGREE TO FUTURE CHANGES TO THIS PRIVACY POLICY, YOU MUST STOP USING OUR SERVICES AFTER THE EFFECTIVE DATE OF SUCH CHANGES. Please note that upon discontinuing use of the Services, any Privacy Policy in effect immediately prior to your departure shall continue to be binding on you and applicable to any data (including, without limitation, Personal Information) collected from you prior to such departure.
